The work
A landscape project is governed by a separate written agreement signed by the client and the studio. The agreement defines scope, schedule, deposit, payment milestones, warranty, and termination. Nothing on this website constitutes a binding offer; it is invitation to begin a conversation.
We do not work without a contract. We do not begin design until a deposit is received. The studio reserves the right to decline a project for any reason — or no reason.
Warranty
Hardscape installations carry a two-year structural warranty against material failure. Planting carries a one-season warranty against transplant loss, subject to the property being maintained on a Scapes service plan. Lighting and irrigation carry the manufacturer's warranty as installed.
Acts of weather — freezes below 20°F, hurricane, flood — are not warrantable. We will however always be there to assess, recommend, and re-quote.
Payment
Invoices are due net 15. Recurring maintenance is billed monthly in advance on the first of the month. Late accounts (over 30 days) suspend service until current.
We accept ACH, check, and credit card (with a 2.9% processing fee). For Reserve denominations over $100,000, wire transfer only.
Liability
We carry general liability, workers' compensation, and commercial auto insurance — current certificates are available on request. Our liability for any individual claim is limited to the value of the contract under which the claim arose, except as required by Texas law.
We do not advise on engineering, structural, or electrical work outside the scope of landscape installation. Where a project requires those disciplines, we coordinate with licensed third parties and the client engages them separately.
Governing law
Texas law governs. Any dispute is resolved by binding arbitration in Houston, Texas, under the rules of the American Arbitration Association. The prevailing party recovers reasonable attorneys' fees.
